Eight and Nine Year Old Boys Face Possible Charges in Shooting Death of Westminster Man

Danny Andrew Smith, 62, was found dead on a running tractor June 23, where he had been bush hogging his family’s property. An autopsy revealed that he had been shot in the back.

The sherif is asking the court to pursue charges of involuntary manslaughter against the two youth.

The substance of our petition is that these boys fired a weapon, a .22 caliber rifle, in the direction of Mr. Smith, in a reckless manner with a disregard for his life,” Crenshaw said in an interview with The Greenville News. “We don’t believe their intent was to kill him.”

At this time, it is still undetermined which shot ultimately struck and killed Mr. Smith,” the agency said in a prepared statement. “However, based upon South Carolina law, the hand of one is the hand of all and that is why Family Court has been petitioned in regards to charging both juveniles with Involuntary Manslaughter.”
